Thad Pirkle to Serve a Year, Part Sixteen: Guinn Sister’s Death

Personally, I think Thad Pirkle should have served a much longer sentence.  He took the lives of two innocent children, who had their whole lives ahead of them.  Their tragic deaths must have had a lasting impact on their family as well.  

I think if this accident had ocurred now, along with the “leaving the scene of an accident” charge and the advanced technology available to use at the accident scene, he would have received a much harsher sentence than the one he received in 1921.

It was hard for me to believe Pirkle was brazen enough to ask for a third trial, especially after receiving a one year sentence.  I hope it was a very long and miserable year for him on the chain gang.

Thad Pirkle to Serve a Year

Thad Pirkle, driver of the automobile which killed two little girls, Madge and Mary Elizabeth*Guinn, in Oakhurst on December 31, 1919**(1920), has ceased his fight for a new trial and will serve his sentence of twelve months on the chaingang.  The hearing upon his motion for a new trial was set for yesterday morning before Judge John B. Hutcheson in Decatur and when the hearing was called attorneys announced that an agreement had been reached that the motion for new trial would be withdrawn.  This will be done formally before Judge Hutcheson Tuesday morning and the court will then turn Pirkle over to the state prison commission to determine when Pirkle will begin serving his sentences.

*the youngest child’s name was Mary Frances, this is the first time I’ve seen her name as Mary Elizabeth

**the date of the accident was December 31, 1920

Atlanta, Nov. 18 – Thad Pirkle, convicted Thursday of involuntary manslaughter in connection with the death last New Year’s Eve in Oakhurst of Madge and Mary Frances Guinn, who were struck by his automobile, was released today under $3,000 bond pending outcome of his motion for a new trial.  Pirkle was sentenced to a year’s imprisonment following the verdict of a jury in the DeKalb Superior Court.

Atlanta, Nov. 17 – A verdict of one year’s imprisonment was returned by a jury in the Superior Court of the Stone Mountain Circuit, trying Thad Pirkle at Decatur for the death of little Madge and Mary Frances Guinn, killed by his automobile on a curve in East Lake drive last New Year’s eve.  The verdict is set both maximum and minimum of one year, declaring Pirkle guilty of manslaughter.  The accused man heard it read without emotion.  His counsel were unwilling to announce if a new trial would be sought.  Pirkle was tried on a murder charge.  The trial was the second given Pirkle.

Pirkle lll; Unable To Attend Trial

Thad Pirkle, charged with murder in connection with the deaths of Madge and Frances Guinn, who were run over by an automobile driven by him on the East Lake drive December 31, was unable to come to the second trial of his case Thursday because of illness.

Attorney Paul Carpenter, leading counsel for the defense, presented a certificate from Dr. J.H. Cross, Jr., stating that Pirkle has been confined to his bed at the home of his father, N.N. Pirkle, for over a week and was in no condition to attend court.

Pirkle was recently allowed his liberty on bond of $5,000.

Trial of Pirkle Begins Thursday In DeKalb Court

Thad Pirkle, charge with murder in connection with the deaths of Madge and Mary Frances Guinn, two little girls who were killed by an automobile driven by Pirkle on December 31, will for the second time face trial in DeKalb superior court today.  Pirkle, who does not deny being the driver of the automobile, was tried on a previous occasion, when a mistrial resulted.

The two children were killed on East Lake drive, in Oakhurst.  In a statement in which he waived preliminary trial, Pirkle stated that he lost control of the car as it was nearing the corner of Second avenue and East Lake drive at a moderate speed, and that it struck the children, plunged along the edge of the woods and was wrecked.

Mistrial Declared In The Pirkle Case, Part Eleven: Guinn Sisters Death

It’s hard to understand why Thad Pirkle and Emma Cooper weren’t charged with leaving the scene of an accident.  Guess it wasn’t on the books in 1921.  That’s a shame.  With the testimony of witnesses who saw him speeding, the street car conductor who said it was apparent Pirkle and Cooper had been drinking, I wouldn’t have had any qualms with finding him guilty.  Wonder what will happen with the second trial?

Mistrial Declared In The Pirkle Case

Jury Fails to Agree, in Case of Autoist Charged With the Killing of Two Girls, After 24 Hours Deliberation

Atlanta, March 19 – Just 24 hours after beginning to consider the case of Thad Pirkle, charged with the murder of Madge and Mary Frances Guinn, the jury in the DeKalb superior court at 11:40 o’clock Saturday morning reported to Judge John B. Hutcheson that it was impossible to reach an agreement as to a verdict, and the judge dismissed the jurors, declaring a mistrial.

None of the jurors would talk about the case after their dismissal, and it was not made known what was the principal point of contention on which their deliberations split hopelessly.

Besides finding the defendant guilty of murder, as indicted, the jury was charged that it could find him guilty of voluntary manslaughter in the commission of an unlawful act, carrying a penalty of from one to three years’ imprisonment, or of involuntary manslaughter in the commission of a lawful act without due care and in such a manner as to be dangerous; this constitution a misdemeanor on which the court would fix the penalty.

There were no issues of the Atlanta Constitution available for the months of March through May, so I had to find another paper to follow this case.

Jury Is Deadlocked On Thad Pirkle Case

Decatur, Ga., March 18 – After deliberating since noon, the jurors in superior court here trying Thad Pirkle, charged with murder of two children who his automobile ran into December 31 last, retired late tonight and announced it resume consideration of the case tomorrow.

The prosecution asked a verdict of murder and contended that Pirkle was drunk when his car struck Madge and Mary Frances Guinn of Kirkwood.  Pirkle denied that he had been drinking and said he accidentally struck the children in dodging a truck.

Bail Is Refused To Thad Pirkle

Must Remain in County Jail Until Further Court Action Is Taken in His Case

Denied bail Saturday morning by Judge John B. Hutcheson of the Stone Mountain Circuit, in Decatur, Thad Pirkle, Atlanta man charged with the murder of two little girls, must remain in the DeKalb county jail until further court action is taken on his case.

Pirkle is the driver of the automobile which crushed to death little Madge and Mary Frances Guinn, on East Lake drive December 31 of last year.  Witnesses testified that the (paper faded) car driven by Pirkle was (paper faded) along at such speed when (paper faded) the girls that it ran be-(paper faded)  the road, crashed into a stump and overturned.  One of the children was killed instantly, the other died in a few minutes.  Neither Pirkle nor the woman in the car with him were seriously injured.

The effort of Pirkle’s attorneys Saturday morning was to have him released on bail, first because they contended this was a bailable case, and secondly, on account of the fact that Pirkle’s health is said to be bad.  W. Schley Howard is aiding the state in the prosecution of the case, while Pirkle is defended by Paul Carpenter and Frank Hooper & Son.
